According to Article 5 of the Regulation on the Facilitation of Customs Procedures regarding the reliability condition for Authorized Economic Operator (AEO) certificate applications; if a prosecution is carried out against the board members, real persons holding 10% or more of the capital, or employees authorized to represent the company in foreign trade transactions regarding the crimes listed in Article 5, the certificate is suspended under Article 154 if it affects the reliability of the company.

With the letter of the General Directorate of Customs dated 18.12.2023 and numbered 91992958; it has been stated that in cases where a “Suspension of the Pronouncement of Judgment” (HAGB) is issued by the competent judicial authority regarding the company officials and this decision becomes final, the suspension process of the certificate carried out in accordance with Article 154 of the Regulation on the Facilitation of Customs Procedures must be terminated.
