Preparation of the Authorized Economic Operator (AEO) Activity Report

The AEO Annual Activity Report is essentially an audit report. In accordance with Article 158 of the Regulation on the Facilitation of Customs Procedures, companies holding an AEO certificate are required to audit whether their customs procedures have been performed in compliance with regulations at the end of each 12-month period following the issuance of the certificate.

This Annual Activity Report must be prepared and filed within 3 months following the end of each period. These reports must be kept on file and presented to the Customs Administration immediately upon request.

Regulatory Context: Article 158 of the Regulation on the Facilitation of Customs Procedures

Article 158, titled “Binding customs transactions carried out within the scope of the certificate to an annual activity report,” mandates the following:

  • Audit Requirement: Every 12 months following the issuance of the certificate, the holder must audit whether customs transactions were conducted in accordance with regulations.

  • Deadline: This audit and the subsequent report must be finalized by the end of the third month following the 12-month period.

  • Outsourcing: Certificate holders may outsource this examination to expert consultancy firms.

  • Sample Size: The audit must cover at least 5% of the total declarations, with a minimum requirement of 50 declarations.

  • Scope of Examination: The audit is not partial; it must verify the accuracy of customs declarations regarding Value, Origin, Tariff Classification, and Quantity by comparing them against accounting records, stock data, and warehouse entry-exit logs.
